Terms of Use

Welcome to www.bvforge.com, the website of Brandywine Forge, a blacksmith shop in Royersford, Pennsylvania, that makes shutter hardware and barn, gate and heavy-door hardware. These Terms of Use (the “Terms”) govern your use of the website and its content, features and forms (together, the “Site”).

By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site. In these Terms, “Brandywine Forge,” “BF,” “we,” “us” and “our” mean Brandywine Forge and its divisions, owners, employees and agents, and “you” means anyone who uses the Site. Effective date: October 5, 2026.

1. Using the Site

The Site is provided to help you learn about historic and contemporary hardware, plan a project and ask us for a quote. You may view, download and print pages from the Site solely for your own personal or project-planning use, such as sharing a page with your builder, architect or historic commission, provided you keep all copyright and other notices intact. You may not otherwise copy, modify, republish, distribute, sell or create derivative works from the Site without our written permission.

You must be at least 18 years old, or the age of majority where you live, to request a quote or place an order. The Site is operated from the United States and intended for use within the United States. If you access it from elsewhere, you do so on your own initiative and are responsible for complying with local laws.

2. Intellectual property

All text, photographs, drawings, graphics, logos, page layouts, product names and software on the Site are owned by or licensed to Brandywine Forge and are protected by United States and international copyright, trademark and other laws. “Brandywine Forge” and the names of our patterns and products are our marks. Nothing on the Site grants you any license or right to use our intellectual property except as stated in these Terms. 3. Quotes, orders and pricing

The Site is not a store

The Site has no online checkout and does not accept payments. The quote list and the contact form let you tell us what you are interested in; submitting them is a request for information and a quote, not an order, and does not create a contract.

Consultation first

We really are a blacksmith shop, and we would much rather make hardware than re-make it. We strongly urge you to call us before ordering, even if you feel you have no questions. Orders are placed by phone or email after we have talked through your project and confirmed the details.

Prices

Prices shown on the Site are for general guidance only. They may be outdated and are subject to change without notice. Current prices, availability, finishes, lead times, shipping charges, applicable taxes and payment terms are confirmed by phone and in our written quote or order confirmation. If a price on the Site differs from the price we quote, the quoted price controls.

Formation of an order

An order is accepted only when we confirm it to you in writing (by email or on paper) and any payment terms stated in that confirmation are met. We may decline any order for any reason, including errors in pricing or description, unavailability of materials, or concerns that the hardware is not suited to the application. Our order confirmation, together with our Shipping, Returns & Made-to-Order Policy, governs the sale. Where an order confirmation conflicts with these Terms, the order confirmation controls for that order.

4. Custom and made-to-order work

Most of our hardware is made to order and fitted to the dimensions you give us. You are responsible for providing accurate measurements, specifications and site conditions, and for reviewing and approving the details we confirm back to you. Hand-made hardware varies within normal tolerances; dimensions shown on the Site are nominal. Because custom work is made specifically for you, it generally cannot be cancelled once work has begun and cannot be returned unless it is defective. Any drawings, sketches or recommendations we provide are offered to help you choose hardware. They are not engineering drawings or approvals. Please read our Disclaimer regarding installation, structural loads, wind ratings and building codes.

5. Your submissions

When you send us information through the Site or by email—questions, measurements, project descriptions, photographs, drawings, testimonials or other material (“Submissions”)—you represent that you have the right to share it and that it does not infringe anyone else’s rights or contain anything unlawful. You keep ownership of your Submissions. You grant us a non-exclusive, royalty-free license to use them to respond to you, prepare quotes and fulfill orders. If you send us photographs of installed hardware or comments about our work, you also permit us to use them, without your name unless you agree, on the Site and in our materials. We may decline, edit or remove any Submission at our discretion. Personal information in Submissions is handled under our Privacy Policy.

If you send us unsolicited ideas or suggestions about designs or products, you agree that we are free to use them without obligation to you.

6. Prohibited uses

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms;
  • Submit material that is false, unlawful, obscene, defamatory, threatening, harassing, or that infringes the copyright or other rights of others;
  • Send spam, advertising or solicitations through our forms, or advertise or solicit on the Site without our written permission;
  • Impersonate another person or misrepresent your affiliation with anyone;
  • Upload or transmit viruses, malware or any code designed to damage, interfere with or gain unauthorized access to the Site, its server or any computer;
  • Scrape, harvest or copy content or email addresses from the Site by automated means;
  • Attempt to probe, scan or test the vulnerability of the Site or circumvent any security measure; or
  • Copy our designs, product photographs or descriptions to sell or promote competing products, or present our work as your own.

We may block access to the Site, refuse service or take other action against anyone who violates these Terms.

7. Third-party links

The Site contains links to other websites, such as those of architects, organizations and projects associated with our work. These links are provided for convenience and information only. We do not control those sites and are not responsible for their content, products, availability or privacy practices. A link does not mean we endorse the site or its owner. You access other sites at your own risk and under their own terms.

8. Disclaimer of warranties

THE SITE AND ALL CONTENT ON IT, INCLUDING MATERIAL PROVIDED BY THIRD PARTIES, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BRANDYWINE FORGE DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE SITE, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, THAT THE SITE OR ITS SERVER ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT INFORMATION ON THE SITE IS ACCURATE, COMPLETE OR CURRENT.

This section concerns the Site itself. Any warranty that applies to hardware you purchase from us is the one stated in your order confirmation and our Shipping, Returns & Made-to-Order Policy.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BRANDYWINE FORGE, ITS OWNERS, EMPLOYEES OR AGENTS, OR ANYONE ELSE INVOLVED IN CREATING, PRODUCING OR DELIVERING THE SITE, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, BENEFITS, USE, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY CONTENT ON IT, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). OUR LIABILITY FOR ANY CLAIM ARISING FROM A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE HARDWARE GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Indemnification

You agree to defend, indemnify and hold harmless Brandywine Forge and its owners, employees and agents from any claims, losses, damages, liabilities, costs and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your Submissions, your infringement of anyone’s rights, or your misuse of the Site.

11. Governing law and venue

These Terms, and any dispute arising out of or relating to them or to the Site, are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. You agree that any legal action will be brought exclusively in the state courts located in Montgomery County, Pennsylvania, or in the United States District Court for the Eastern District of Pennsylvania, and you consent to the personal jurisdiction of those courts. Before filing any claim, we ask that you contact us so we can try to resolve the matter informally; most problems can be settled with a phone call.

12. Severability and waiver

If any provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with the policies referenced in them and any order confirmation, are the entire agreement between you and us about the Site.

13. Changes to these Terms

We may revise these Terms at any time by posting an updated version on this page and changing the “Last updated” date. Changes apply from the date they are posted and do not affect orders already confirmed. Your continued use of the Site after a change means you accept the revised Terms. We may also change, suspend or discontinue any part of the Site at any time.
